Introduction 

In addition to the Terms of Use that govern your use of the Lady Bespoke.com Website (the “Site”), these Terms of Sale (the “Terms”) govern any transaction between Lady Bespoke Inc. (also operating and referred to herein and on the Site as “Lady Bespoke,” “LadyBespoke.com,” “we” and “us”) and its customers (“customer,” “you,” or “your,”), whether made online (“LadyBespoke.com”), at pop-up events or at any Lady Bespoke licensed location (“Showroom”). Pop-up events, showrooms and LadyBespoke.com will be referred together as “Lady Bespoke Stores”.

Lady Bespoke Inc. is the operator of the Site and the supplier for your order. We strive to give you a satisfying experience every time you visit one of the Lady Bespoke Stores. By creating an account, submitted an order and/or making a purchase at any Lady Bespoke Store, you agree to be bound by these Terms of Sale, whether or not you have read them. If you do not agree to these Terms of Sale, do not proceed with your order. Please print and retain a copy of these Terms of Sale for your records.

Service Provided 

Lady Bespoke offers affordable quality custom clothing for global women. On the Site, we do our best to provide detailed product descriptions and 3D visualizations of the products that you wish to design. While we try to accurately display the colour of our products on the Site, the actual colours you see depends on your monitor and the setting of your screen, and thus we cannot guarantee that the colours displayed on your monitor will be exactly the same colour of the product at the time of delivery and/or receiving.

The final products you receive may be slightly different in appearance to those shown and described on the Site due to many factors including the settings of your monitor and your device hardware and the variations in manufacturing processes.

Order

You will need to create an account to place an order on the Site. The receipt of your order will be confirmed via an automatic email to the email address associated with your account. Such email is a confirmation that your order has been received by Lady Bespoke but does not constitute an acceptance of your order. A shipping confirmation email will be sent to confirm that your order has been accepted and that the order has been shipped.

Lady Bespoke reserves the right, at its sole discretion and at any time after receiving your order, to accept, refuse, place on hold or cancel any order for any reason. Some situations that may result in your order being cancelled or refused are: (i) if your measurements fall outside the range of our available pattern; (ii) limitations on fabric or accessories available for purchase; (iii) the right to limit quantities purchased (iv) inaccuracies or errors in product or pricing information on the Site; or (v) our inability to confirm or obtain authorization for charges to your credit card.

We may also require additional verifications or information before accepting any order. Lady Bespoke will contact you if all or any portion of your order is cancelled or if additional information including measurements – even pictures – or customizations is required to accept your order. It is your sole responsibility to deliver the additional information to Lady Bespoke in a timely and opportune manner. Lady Bespoke reserves the right, in its sole discretion, to place your order on-hold or even cancel it if the requested information is not received in time or is incomplete. Orders on-hold will be automatically cancelled 15 days after being submitted if there’s missing information, and a credit will be issued according to these Terms.

In the event Lady Bespoke makes a change to or cancels an order, we will attempt to notify you by contacting the e-mail and/or phone number provided at the time the order was submitted. If your order is cancelled, Lady Bespoke will issue a credit for future use equal to the billed amount, per these Terms.

We custom made every garment order with one of the world’s fastest turnaround time. If you wish to make changes or cancel your order, please contact us by Whatsapp only at +1-416-897-7336, within 24 hours of submitting your order. We cannot guarantee any order changes or cancellations requested via email, at any time, even during this timeframe. Please ensure to double check your fabric selection, measurements and customization before submitting. You may be able to cancel your order if we have not yet started to process it. You can confirm the status of your order and whether or not it can be cancelled here.

Prices and Currency: The prices displayed on the Site are shown in American dollars unless stated otherwise. Shipping and handling fees and taxes are listed, if applicable. You are responsible for the payment of any shipping and handling fees and any federal or provincial taxes that may apply to your order. These fees and taxes are added to the order price during the checkout process.

Payment Method: You may pay for your order using American Express, MasterCard, Visa or credit cards issued by banks located in these countries. When paying by credit card, your name and billing address must match the address on file with the card issuer.

We also accept Lady Bespoke online gift certificates, Lady Bespoke gift cards, PayPal® and credit card gift cards. Credit card gift cards can only be redeemed for orders less than the full amount available on the credit card gift card.

In all cases, you authorize Lady Bespoke to charge the applicable payment method the total amount of your order, including applicable taxes and shipping and handling fees. You represent and warrant that you are the holder of the applicable card or account. If your payment method cannot be validated or processed, your order will not be shipped and Lady Bespoke will have no obligation to fulfil your order.

Promotion Codes: Only one promotion code may be used per order. We reserve the right to cancel orders if an unauthorized promotion code is used.

Availability and Descriptions

The purchase of products on the Site is subject to availability. In the event that the product you request is not available at the time of your order, Lady Bespoke will have no obligation to fulfil your order and you will have no obligation to pay Lady Bespoke for the order. Adding products to your Shopping Bag or Wish List does not guarantee availability at the time of your order.

Although we strive to update and keep accurate product and pricing information on the Site, errors and/or omissions may occur. In the event that an item is listed at an incorrect price or with incorrect information, Lady Bespoke shall have the right, at its sole discretion, to refuse or cancel any orders placed for that item. If an item is incorrectly priced and Lady Bespoke elects to refuse or cancel your order, we will notify you of such refusal or cancellation.

PRODUCTS DISPLAYED ON THE WEBSITE MAY NOT BE AVAILABLE AT ALL TIMES. PRODUCTS AND PRICES MAY BE CHANGED. PRODUCTS MAY BE SUBSTITUTED OR DISCONTINUED AT ANY TIME. WHILE WE ATTEMPT TO PROVIDE AN ACCURATE DESCRIPTION OF ITEMS AVAILABLE FOR PURCHASE ON THE WEBSITE, WE DO NOT WARRANT THE ACCURACY, COMPLETENESS, RELIABILITY OR CURRENCY OF SUCH DESCRIPTIONS.

Shipping and Delivery

Lady Bespoke may offer free shipping on orders over a certain threshold. For orders outside of the United States and Canada, or orders that do not meet the free shipping threshold, Lady Bespoke will charge a shipping fee per order. Each address you choose to ship to, including gift-recipient addresses, is considered a separate order and is subject to applicable shipping and handling fees and taxes. Gift Cards ship for free, but do not count towards the shipping threshold. Your order will be shipped to you via a recognized carrier and will notify you once your order has been shipped. Lady Bespoke is not responsible for any loss of the products following shipment from Lady Bespoke or its agents’ facilities to your delivery address.

Prices reflected on the Site include any duty/customs charges for orders within the United States and Canada unless expressly stated otherwise. If you’re asked to pay any customs charges on your order within the United States or Canada, please contact our Customer Care Team with the respective proof of payment for our review.

Additional shipping charges and duty/customs may apply for addresses outside of the United States and Canada, which shall be the sole responsibility of the customer, as the importer of record.

Our 10-day (or 20 days for custom print linings) delivery promise covers the time we receive your order and your payment to when we dispatch it. It applied to customers with completed measurement profiles with Lady Bespoke and excludes shipping times. Our delivery promise applies to orders that do not have the following holds which may delay production: incomplete measurements, measurement discrepancies, payment issues, groups, out of stock fabrics, customization errors and/or holds as requested by the customer. The orders placed on hold as determined by Lady Bespoke do not qualify for the 15-day promise (or 25-day promise for orders with custom print linings).

Shipping to majority of global addresses usually takes approximately 5 days. All estimated shipping dates regarding your order provided by Lady Bespoke to you, shall be for reference only and may not be considered a guarantee, compromise or commitment from Lady Bespoke to deliver your order to you on such date. Since the actual delivery of your order can be impacted by events beyond Lady Bespoke’s control (weather conditions, strike, public holidays, etc.) once it has been shipped, Lady Bespoke cannot be held liable for late deliveries.

If you need your garments for a special event or specific date, we encourage you to submit your order with at least 90 days in advance of your event or date.

Group Orders

Lady Bespoke, in its sole discretion, may offer a discount or promotion to parties or groups that meet certain requirements established by Lady Bespoke. In order to qualify for such discount or promotion, all members of the party or group shall meet the criteria and comply with the conditions set forth by Lady Bespoke, including the submission of the orders with the time in advance requested by Lady Bespoke.

Lady Bespoke reserves the right to cancel or rescind any discount or promotion code granted to parties or groups if it determines in its sole discretion that a participating customer has violated these Terms or the conditions for such promotion.

Alterations

Lady Bespoke believe that fit is the most important part of a good garment and we want you to receive the best made to measure shopping experience possible. Should any of your garments need alterations, please see your options below.

Please notify us within 10 days from the date you received your order by contacting our Customer Care Team or booking an appointment at any of our Showrooms. You will not be able to apply for any alterations once the applicable period has expired. Please make sure to contact our Customer Care Team if you have any difficulty submitting your application before the expiration of such period.

All Lady Bespoke made to measure garments are made to your unique measurements and customizations so they may require adjustments that can be handled by completing alterations.

You can book an appointment at any of our Showrooms once you have received your order. Our Showroom staff will guide you through the process and will take care of any alterations that are required in your order and update your measurement profile on your account once the alterations have been completed.

If you don’t have access to any of our Showrooms, Lady Bespoke offers an alteration credit of up to $75 Dollars for orders delivered within the United States or Canada to put towards local tailoring, according to the chart below. The alteration credit per garment may not be combined with one another – this means you won’t be able to apply for extra alteration credit for one garment in detriment of other garment’s alteration credit. We can only accept alterations claims within the United and Canada at this time.

  • Suits (2 Pieces) – Complete: up to $75
  • Jackets, Blazers & Overcoats – Separates: up to $50
  • Pants & Skirts: up to $25
  • Shirts: up to $20

Follow the guidelines below to apply for the alteration credit reimbursement:

  1. Download and print the Alteration Form found on our Alterations Section and make sure to bring it to your local tailor or seamstress.
  2. Have your tailor fill the Alteration Form and give you a copy of your receipt.
  3. You will have to input the measurement changes/alterations made by your tailor/seamstress, so we can update your measurement profile for future orders.
  4. Upload a photographed or scanned copy of your receipt. Make sure your tailor/seamstress is confident in being able to solve the fit issue on your garment for you, as you won’t be able to apply for any other claim after your garment has been altered.
  5. If completed correctly, you can expect your credit appear on your original form of payment in the next 14 business days, except payments made by debit or cash, which will be refunded via PayPal.

In the event your local tailor is not able to help you with alterations, please contact our Customer Care Team, noting the adjustments needed and pictures of yourself wearing the garments. Our Customer Care Team members will make an expert assessment and provide a recommendation on next steps.

Remakes

If a remake is needed, Lady Bespoke will use the same fabric as your original order. However, due to limited availability, some products may be unavailable to be remade, and you may be asked to choose an alternative product or fabric for your remake, per these Terms. If a remake is needed on a product or item that was purchased as a clearance item – even if temporarily included in that collection – and a replacement fabric is needed, you will be asked to choose another fabric from the same clearance collection or pay the price adjustment, according to these Terms.

Lady Bespoke will not remake an item in the following circumstances: i) when alterations can be completed locally; ii) when the garment has already been altered by a local tailor and/or customer has already applied for alteration credit on that same garment – unless the alteration credit is reimbursed to Lady Bespoke in full; iii) when the remake request is not related to any fit issues with the garment, other than quality or manufacturing issues; iv) when the remake request is based on customization changes or errors/mistakes at the time of placing your order, other than mistakes or errors made by Lady Bespoke at the time of producing your garments; and v) any other circumstance which Lady Bespoke in its sole discretion may deem that a remake is not warranted.

Returns

Please note that we do not offer refunds, as fabric for each of your made to measure garments is cut based on your measurements and customizations.

If there’s any issue related to the quality of fabrication of your garments, please contact our Customer Care Team within 10 days after receiving your order for assistance. Alternatively, you can bring the garment to any of our Showrooms or submit the return claim online through your account. Customers can expect to receive a credit for future use within 14 business days after the return has been processed by Lady Bespoke.

Lady Bespoke reserves the right in its sole discretion to deny the issuance of a credit for an item tag that is believed to be previously worn or damaged. Garments that have already been altered or adjusted in any way, do not qualify to be returned. Any items returned to Lady Bespoke that do not meet the aforementioned requirements will be sent back to the customer without processing and without any further obligation from Lady Bespoke. You must return all items purchased as part of the promotion to receive a full credit and those items not returned will be charged at our posted prices before promotion.

Once you have applied for a return, Lady Bespoke will send you a pre-paid return label if you live in the United States or Canada. After receiving the items back, Lady Bespoke will process your return and issue a credit for future use. If your order was paid with a coupon or Gift Card, the coupon or Gift Card will be credited before issuing another credit. No refund will be accepted once an alteration has been completed. Include your original order number as reference to ensure no delays in processing your return. If you have any questions regarding your return, please contact our Customer Care Team.

In circumstances where you wish to return an item that was purchased using a special multiunit price (i.e. promotions, bundles), in exchange for a store credit, then crediting you the single unit price will be at the discretion of Lady Bespoke.

Price Adjustment 

If we make a permanent price reduction on a good that you have purchased from the Site, you may request a refund of the price difference within ten (10) days of the delivery date of the relevant good. Please be aware that the exact style, fabric of the relevant good must be available for purchase at the time you request the refund in order to qualify for the price adjustment. Price adjustments are accepted on goods purchased at the full retail price only. Please note that promotional sales prices are not permanent price changes and are not included in this guarantee. Quantity Limits

Lady Bespoke reserves the right, at its sole discretion, to limit the quantity of items purchased per person, per household and per order. These restrictions may be applicable to orders placed by the same account, the same credit card, and also to orders that use the same billing and/or shipping address. We will provide notification to you should such limits be applied. Lady Bespoke also reserves the right, at its sole discretion, to prohibit sales to dealers or resellers.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LADY BESPOKE DISCLAIMS ALL WARRANTIES WITH RESPECT TO ITS PRODUCTS, INCLUDING ANY WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. BECAUSE SOME JURISDICTIONS DO NOT PERMIT THE EXCLUSION OF CERTAIN WARRANTIES, THESE EXCLUSIONS MAY NOT APPLY TO YOU.

Final Provisions

The Terms of Sale applicable to your order are the Terms of Sale in effect on the date that you place your order, as made available to you when you complete the checkout process. Lady Bespoke may modify its Terms of Sale from time to time in accordance with applicable laws. Any such modification will apply to any order placed after the effective date of the modification. Therefore, each time you place an order with Lady Bespoke, you represent that you have accessed, read and accepted the Terms of Sale applicable to and governing that order.

You agree to hold harmless and indemnify Lady Bespoke, its agents and representatives against any and all liability, damages or causes of action (however named or described with respect to or arising out of either: i) your transaction with Lady Bespoke; ii) your use of any Lady Bespoke Stores; or iii) your breach of any representation, warranty, or other provision of these Terms.

You hereby release, waive and discharge any and all claims of damage, loss or causes of action which you or any of your representatives, heirs, next of kin or assignees may have or which may hereinafter accrue to such persons against Lady Bespoke, its agents and representatives as a result of your transactions with Lady Bespoke.

These Terms of Sale will be governed by the laws of the province of Ontario and the laws of Canada applicable therein unless the applicable laws of your province of residence require that the laws of such province govern, in which case, the laws of such province are to govern. The exclusive jurisdiction for any claim, action or dispute with Lady Bespoke or relating in any way to your use of the Site or a purchase made on the Site will be in the courts of the province of Ontario unless required otherwise by applicable laws of your province of residence.
